Please read the Terms carefully before using our Systems or Services.
Mantrah Corporation (“Mantrah” or “we”) provides software-based technologies, including mobile applications, that seek to help users (“you”). By using the Systems, Services, or clicking the “accept” checkbox on our app registration page you agree to be bound by the Terms. If you do not agree to the Terms, you may not use our Systems or Services and ask that you delete our app from your devices.
Your use of the Systems and Services is at your risk.
Mantrah does not provide medical advice. You must consult qualified medical professionals to make any medical decisions. You will be responsible for consulting with medical professionals before implementing any idea presented by the Systems or Services and for ensuring that, notwithstanding anything in the Systems or Services, you comply with professional medical advice.
We make no representations or warranties whatsoever for the Systems or Services, including that they will function as desired, intended, without error or interruption. We disclaim all liability arising from the use of the Systems or Services, such use being at your exclusive risk, the Systems and Services being presented as-is.
Information regarding medical conditions, medications, diagnoses, health, fitness, or care plan activities may be provided using third-party content or information providers. We do not assume and will not accept any liability whatsoever in respect of any such content that is provided by third parties and/or any other users of the service.
Our Technology and Support
We do not warrant or guarantee that our Systems or Services will function on your mobile or computing device, including without any issues. Information will be transmitted over data and communications networks that we do not control, that may affect our ability to deliver Systems and Services, including access to the Systems and Services including notifications that could remind users to perform certain activities at particular times. We make no representations or warranties about the availability, accuracy, quality, and performance of our Systems or Services.
You agree that you will not:
reproduce, reverse engineer, copy or otherwise exploit or misuse the Systems or Services.
impersonate another person or user, including to gain access to their personal information including their health information, medical records, email addresses, and passwords.
electronically post, share, or otherwise publish any false information.
act to disrupt our Systems or Services or prevent others from using our System or Services.
Post any information that is protected by copyright or that you are otherwise prohibited from posting.
Subject to your compliance with the Terms, we grant you a limited, non-exclusive, non-transferrable license to access and use our Systems and Services. That license to use is granted for personal and non-commercial purposes only. That license may be withdrawn at any time.
Mantrah, its affiliates or licensors own the Systems and Services, all material, content, documentation, user guides, or other support services associated therewith and reserved all rights therein.
Intellectual Property Rights
The Systems and Services, including user interfaces, design, content, graphics, and technical functionality of the Systems and Services are protected by United States and other copyright laws. Mantrah, its affiliates, or licensors reserves all rights therein. You may not reproduce or store in any medium or transmit in any form our Systems and Services or any portion thereof, including screenshots, without our express written consent.
Limitation of Liability
Mantrah’s liability to you for all claims, in the aggregate, regardless of the basis thereof and without regard to whether Mantrah has notice of potential liability, will be limited to US$10.
You will indemnify Mantrah for any liability arising from your use or failure to use the Systems and Services, any action in breach of the Terms, including seeking to pursue any claim in excess of the amounts allowed hereunder and for claims of third parties. The foregoing will include reimbursement for attorney’s fees and costs as they are incurred.
The Terms will be governed by and construed under the laws of the United States and the State of Maryland as though the entirely performed in Maryland and without regard to otherwise applicable conflict of laws statutes/rules. Any action brought under the Terms will be subject to the exclusive jurisdiction of the courts Maryland or the courts of the District of Maryland and the courts of appeal therefrom without any claim of lack of jurisdiction or that the selected courts are an inconvenient forum. Any right to a trial by jury in any matter arising hereunder is waived.
Any matter pursued in connection with the Terms may be brought only in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.
No matter may be brought in connection with the Terms unless commenced within six months from the date of the alleged incident.
I. Our principles on managing data
Mantrah will collect data, including through our Systems, only for legitimate purposes and to the extent that such data is necessary for us to provide our Services. All data will be processed lawfully, managed using methods reasonably believed to be secure, and only kept for as long as reasonably necessary for us to provide you with Services.
II. What information we collect from you
For you or your agent, which may be a caregiver, to use our Systems and Services we need to collect data from you that may include personal information. We collect personal information from you when you or your agent access our Systems, enter data directly into our Systems, through forms or other means of contacting us such as email, or from other third-party apps, websites, and other systems and sources from which you allow us to read or receive data. We may also collect personal information from other health tracking technology or apps such as Apple’s HealthKit as well as health and activity tracking devices. You and your agent may also respond to surveys that we or a third party on our behalf send and via which you may provide additional information, including personal information.
Personal information that we may collect includes: first and last names, phone numbers, email addresses, date of birth, location, medicines, care plan activities, other activities, location, data from medical devices, medical history, your diagnosed medical conditions, medical appointments, personal appointments and details of your healthcare professionals. We may also collect information about any device you might use to access our services. Such information may include IP addresses, browser types, operating system versions, device models, and usage of cookies.
III. How we use the information we collect from you
We will only collect information necessary to deliver Services or allow the use of our System.
Your personal information is used to design and tailor and personalize our Services for you, including to provide you with insights into your condition, help track your progress and give you information to better manage your care.
We may periodically send you curated third-party content or links to such material (such as videos or webpages) based on your care plan activities or progress of your condition.
We will not share your personal information with any third-party partners or content providers without your consent.
We may, based on statistical analysis, make recommendations that may have a positive impact on your health as well as improve your experience of our Services and Systems.
We may use, aggregated or anonymized data, in which your personal information may be included, to generate publicity or as part of our marketing. We may also use such aggregated or anonymized data for health or medical research.
We may disclose your personal information to comply with legal obligations, including defending legal claims in court or as part of out of court settlements.
IV. How we store and secure your data
Any personal information that we collect from you that resides outside of your device will be stored on our secure servers or secure cloud servers with industry-leading trusted third-party providers such as Amazon Web Services, Microsoft Azure, or Google Cloud.
Your personal information may be stored outside of your country of residence based on the storage systems provided to us by the cloud service providers.
V. Your rights
You have the right to delete your personal information by deleting the app associated with the Services from your device. Any data stored on our servers will be deleted within ten (10) days of when you delete that app from your device.
VI. Deidentification and Deidentified Data
An element of the Services and Systems, their development and continuous improvement will be the use of data collected over time, including on the use thereof. Mantrah may maintain copies of de-identified data that it cannot reasonably be associated back to an identifiable person. Such collected data will be the exclusive property of Mantrah.
VII. Changes to this Policy
We reserve the right to change this policy from time to time by posting them here. We may notify you of changes and seek your consent to them. We reserve the right to withhold usage of our Services and Systems if you decide not to accept our revised policy.
